If, in the rare instance, you have been so inconvenienced by a fault with your lease vehicle here is a guide on what you can do.
Drivers can rest assured that all manufacturers carry out intensive checks on all vehicles before shipment. Prior to the delivery of the car, dealers are required to complete a pre-delivery inspection (PDI) before they hand it over to you. The car is examined to make sure it is working with no mechanical issues and is ready and safe to be driven on the road. You, as the driver, must also sign off on this to say you are happy with the car.
Can I have the lease agreement cancelled?
This is extremely rare. This is because for that to happen, the vehicle's manufacturer would first need to agree to take the car back from the lease provider due to fault. For the manufacturer to accept it back, you would have had to experience the same fault 3 times.
Does the 14 day cooling off period apply?
In short, no.
You may be familiar with the 14 day cooling off period. This is where you as a consumer have the right to cancel an agreement with a business within 14 days of delivery of the service or goods. However, this only applies to business to customer (B2C). The cars in EV salary sacrifices are lease agreements between your company and the lease provider. Therefore, it is a business to business (B2B) service and B2C regulations do not apply.

Inform the lease provider
The lease provider is the owner of the vehicle, so you will need to get in touch with them to let them know you are having issues. Each lease provider has a different process depending on the nature of the fault and the manufacturer.

What should I do if I am not happy with the resolution the lease provider offers?
You can raise a complaint with The BVRLA. They run a Trading Standards Institute-approved alternative dispute resolution (ADR) which is available once you have gone through the lease providers formal complaints process and you still remain dissatisfied.
If they find in your favour, they will tell the lease provider to put things right by refunding in full any unjustified charges incorrectly raised. BVRLA members must comply with the rulings of the ADR service.
Please bear in mind that, although ECS will do our best to provide support and guidance so you can get the outcome that is best for you, we are not able to overturn any decisions made by your lease provider.
